These Terms of Service ("Terms") govern your access to and use of SoftwareLit ("SoftwareLit," "we," "us," or "our"), including our website, memberships, courses, tools, assessments, resources, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may, not use the Services.

1. Overview of Services

SoftwareLit provides educational training and resources designed to improve software literacy for individuals and organizations.

The Services May Include

• On-demand online courses, delivered in SCORM format through our learning and membership platform

• Free courses and paid memberships for individuals and organizations

• Certificates of completion for completed courses

• Interactive course activities, including practice sandboxes and software evaluation and planning activities

• Reference tools such as our Business Software Glossary and Software Directory

• Workbooks, guides, and downloadable resources

• Implementation frameworks and planning materials

We may modify, update, or discontinue any part of the Services at any time without notice.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

3. Accounts and Access

Some features require you to create an account.

You Agree To

• Provide accurate and complete information

• Maintain the confidentiality of your login credentials

• Accept responsibility for all activity under your account

We may suspend or terminate accounts that violate these Terms.

Organizational Accounts

If your access is provided by an organization through an Enterprise membership, that organization may assign courses to you and view your course enrollment, progress, completion, and certificates. Your organization's agreement with SoftwareLit may include additional terms.

4. User Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You Agree Not To

• Misuse or disrupt the Services

• Attempt unauthorized access to systems or accounts

• Use the Services for unlawful or fraudulent purposes

• Copy, distribute, or resell content without permission

• Share your account or course access with others

5. Purchases, Payments, and Access

Some Services require payment.

By Purchasing, You Agree That

• Pricing is displayed prior to purchase

• Payments are processed through third-party providers

• Access is granted upon successful payment unless otherwise stated

We may update pricing at any time. Price changes do not affect completed purchases.

6. Refunds, Cancellations, and Renewals

Membership Cancellation

• You may cancel at any time

• Access continues until the end of the current billing period

• No additional charges will occur after cancellation

No Refunds

All fees are non-refundable, including partial billing periods or unused access, except where required by law.

By purchasing, you acknowledge and agree that no refunds will be issued. Our Refund & Cancellation Policy provides more detail.

Automatic Renewal

Memberships automatically renew unless canceled before the renewal date. You authorize recurring charges to your selected payment method.

7. Acceptable Use

You agree not to:

• Interfere with or disrupt the Services

• Attempt to gain unauthorized access

• Reverse engineer or copy proprietary systems

• Use the Services for unlawful activities

8. Intellectual Property

All content within SoftwareLit, including but not limited to courses, tools, frameworks, branding, and materials, is owned by SoftwareLit or its licensors.

You are granted a limited, non-exclusive, non-transferable license for personal or internal business use only.

You may not copy, reproduce, distribute, or resell any content without prior written permission.

9. User Content

You retain ownership of any content you submit, including responses you enter in courses.

By submitting content, you grant SoftwareLit a limited, worldwide, non-exclusive license to:

• Operate and provide the Services

• Improve and develop features

• Generate outputs such as workbooks, reports, plans, and certificates

We do not sell your content.

10. Privacy

Your use of the Services is also governed by our Privacy Policy and Data Safety Notice.

By using the Services, you agree to the collection and use of information as described in those documents.

11. Data Protection (GDPR and CCPA)

We comply with applicable data protection laws, including GDPR and CCPA/CPRA.

Depending on your jurisdiction, you may have rights to access, delete, correct, or export your personal

data as outlined in the Privacy Policy.

We do not sell personal data.

12. Third-Party Services

The Services integrate third-party services such as our learning and membership platform, payment processors, analytics tools, and hosting providers. Our Software Directory also links to third-party software vendors.

We are not responsible for the content, policies, pricing, or actions of third-party services or vendors.

13. Disclaimers

The Services are provided for educational and informational purposes only.

No Guarantees

We do not guarantee any specific outcomes, including but not limited to:

• Business performance

• Productivity improvements

• Operational results

• Software selection outcomes

You are solely responsible for decisions made using the Services. SoftwareLit is not responsible for any

outcomes resulting from your use of tools, recommendations, or frameworks.

Certificates of Completion

Certificates of completion recognize that you completed a SoftwareLit course. They are not a professional license, accreditation, or industry

certification.

Software Directory and Vendor Information

Software listings, pricing notes, and feature descriptions are provided for educational reference and may not reflect current offerings. Always confirm details directly with the vendor. A listing does not mean SoftwareLit endorses a product.

AI-Generated Content and Outputs

Some features of the Services may rely on automated or AI-generated outputs that may contain errors, omissions, or outdated information. These outputs should not be considered professional advice or relied upon as the sole basis for decision-making.

You are solely responsible for evaluating and verifying any outputs before relying on them. SoftwareLit does not guarantee the accuracy, reliability, or suitability of AI-generated content.

Accuracy of Information

We make reasonable efforts to ensure the accuracy and quality of the Services; however, we do not guarantee that all content, recommendations, or outputs are free from errors, omissions, or outdated information.

Data Storage

Course progress and related information are recorded through our learning and membership platform, and some course features may also store information in your web browser. We do not guarantee data persistence. Data may be lost, cleared, or unavailable at any time.

You are responsible for maintaining copies of any important information, such as downloading or printing your workbook and certificate.

Any case studies, examples, or scenarios may be real, anonymized, or hypothetical. They are for educational purposes only and do not guarantee results.

Practice Sandboxes and Demo Tools

Practice sandboxes and demo environments are simplified educational representations. They do not replicate real-world software systems or guarantee equivalent performance or functionality.

Our total liability is limited to the amount you paid in the last 12 months.

Any dispute arising from these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA), except where prohibited by law.

You waive the right to a jury trial or participation in class actions.

Either party may bring claims in small claims court where eligible.
